SWFL Spotlight Photo & Video License Terms

Effective Date: 01 January 2025

All photos, videos, and related media published, sold, or distributed by SWFL Spotlight and/or MelloD Designs are protected by United States copyright law and remain the intellectual property of SWFL Spotlight / MelloD Designs unless otherwise agreed in writing.

By purchasing, downloading, accessing, or using media from SWFL Spotlight, you agree to the following license terms.

1. Personal Use License

Your purchase grants you a limited, non-exclusive, non-transferable personal-use license.

You may:

  • Share purchased photos or videos on personal social media accounts
  • Use purchased media for personal, non-commercial purposes
  • Print purchased digital images for personal display or keepsakes
  • Share media privately with friends and family

This license is granted only to the original purchaser and may not be transferred or sublicensed.

2. Prohibited Uses

You may NOT:

  • Sell, sublicense, redistribute, or commercially exploit the media
  • Use media for advertising, marketing, sponsorships, or promotions
  • Submit or provide media to news outlets, publishers, blogs, broadcasters, or commercial media organizations
  • Use media in business materials, websites, promotional graphics, brochures, flyers, advertisements, or merchandise
  • Alter, remove, crop out, obscure, or manipulate watermarks on preview images
  • Claim ownership, authorship, or exclusive rights to the media
  • Resell or distribute purchased files to third parties
  • Use purchased media as stock photography or stock video
  • Use media in NFTs, blockchain assets, templates, or resale products
  • Use media for AI training, machine learning datasets, facial recognition systems, synthetic media generation, or similar technologies without explicit written permission

3. Commercial & Editorial Licensing

Separate licensing is required for any commercial, editorial, promotional, organizational, or media-related use.

This includes, but is not limited to:

  • News agencies
  • Newspapers
  • Television stations
  • Publishers
  • Blogs and online media outlets
  • Businesses and brands
  • Sponsors
  • Event organizers
  • Vendors
  • Venues
  • Tourism organizations
  • Performers, entertainers, and public figures
  • Nonprofit organizations using media for promotional purposes

Commercial or editorial usage without written authorization is strictly prohibited.

4. Social Media Sharing

Purchased media may be shared on personal social media platforms provided:

  • The media is not used commercially
  • The media is not altered in a misleading or defamatory manner
  • Credit to SWFL Spotlight is appreciated where practical

Examples of permitted use:

  • Posting your event photo on Facebook, Instagram, TikTok, LinkedIn, or X for personal sharing
  • Sharing family or performance photos with friends and relatives

Examples of prohibited use:

  • A business using purchased media in advertising
  • An organization reposting images for marketing campaigns
  • A media outlet republishing purchased content
  • A sponsor using images in promotional materials

5. Watermarked Previews

Watermarked preview images displayed on SWFL Spotlight galleries are provided solely for viewing and purchase evaluation.

You may not:

  • Screenshot preview images for reuse
  • Remove or obscure watermarks
  • Redistribute preview images
  • Use preview images commercially or editorially

Purchased downloads are provided without watermarks unless otherwise specified.

6. Copyright Ownership

All copyrights and intellectual property rights remain exclusively owned by SWFL Spotlight and/or MelloD Designs.

Purchasing a download or print does NOT transfer copyright ownership.

No ownership rights are granted to purchasers beyond the limited license described herein.

7. Right to Revoke License

SWFL Spotlight reserves the right to revoke licensing access for violations of these terms.

Unauthorized commercial use, redistribution, AI usage, or copyright infringement may result in:

  • revocation of access
  • takedown requests
  • invoice demands for retroactive commercial licensing
  • legal action where appropriate
